These Terms and Conditions apply to all bookings made with Himalayan Rides Pvt. Ltd., a company registered in Nepal with its office located at 302 Baluwatar, Kathmandu 44616. By booking a trip with us, you agree to the following terms which govern your participation in any of our adventures.

1. Booking and Payment

A booking is confirmed once we receive your completed booking form and a deposit as outlined during your registration or inquiry. The remaining balance must be paid before the due date communicated at the time of booking. If full payment is not received on time, we reserve the right to cancel your booking and retain your deposit.

All payments should be made in the currency and method specified during the booking process. Bank charges, transfer fees, or currency exchange fees are the responsibility of the client.

2. Cancellations and Refunds

Our adventures are planned many months in advance, with significant costs and logistical commitments borne by Himalayan Rides long before the tour begins. Additionally, because participants often plan their travels well ahead of time, a late cancellation usually does not allow us enough time to fill a vacancy that could have otherwise been sold.

For these reasons, we maintain a no refund policy for any cancellations made by the client. We strongly advise all participants to purchase comprehensive Trip Cancellation Insurance immediately upon booking. This ensures you are protected against unforeseen circumstances that may prevent you from joining the tour, allowing you to recover your costs through your insurance provider.

If Himalayan Rides must cancel your trip for any reason, including but not limited to insufficient participant numbers, we will offer you the choice of a full refund or a transfer of your payment to an alternative trip or departure date.

3. Travel Insurance and Global Rescue Membership

All clients are required to have comprehensive travel insurance for the duration of their trip. Your insurance should cover personal injury, medical treatment, repatriation, trip cancellation, and loss of luggage. Proof of coverage may be requested before or during your trip.

Himalayan Rides includes a Global Rescue Basic Membership with all of our tours. This membership provides 24/7 medical advisory services, field rescue from the point of illness or injury to the nearest appropriate medical facility, and medical evacuation to your home hospital of choice if you are hospitalized more than 100 miles from home. Any medical costs, liability claims, or other expenses not explicitly covered by the Global Rescue membership are the sole responsibility of the participant.

4. Changes to Itinerary

A motorcycle journey through the Himalayas is a living thing; conditions are constantly evolving, and itineraries may change and adapt over time. While we do our best to operate all trips as advertised, Himalayan Rides reserves the right to make changes to the itinerary at any time due to weather, road conditions, political unrest, natural events, or other circumstances beyond our control.

The Force Majeure factors listed above may occasionally result in certain segments of the itinerary being unfulfilled. This includes, but is not limited to, road closures, landslides, or safety related grounding of regional transport. In such instances, the safety of our riders remains our absolute priority, and Himalayan Rides shall not be held liable for any missed activities, shortened segments, or the inability to reach a specific destination.

In extremely rare circumstances, our local team may offer alternative solutions, such as a new destination or helicopter transfers, at an additional cost. These options are provided in good faith and are completely optional for the participant. Any modifications are made with your safety and the quality of your overall experience in mind.

5. Fitness, Health, and Safety

By booking a trip with Himalayan Rides, you confirm that you are physically fit and capable of participating in your chosen adventure. It is your responsibility to consult with a physician regarding your fitness for high altitude travel and to inform us of any medical conditions, allergies, or dietary restrictions before your trip begins.

In remote environments, access to medical care may be limited, and you acknowledge and accept the inherent risks of outdoor travel in rugged and high altitude regions. Himalayan Rides reserves the right to prevent a participant from continuing if a guide deems their health or condition a safety risk to themselves or the group.

6. Personal Conduct

We reserve the right to remove any participant from a trip if their behavior is deemed unsafe, disrespectful, or disruptive to the group, guides, or local communities. Himalayan Rides maintains a zero tolerance policy regarding the consumption of alcohol or any prohibited substances during riding hours. This restriction applies to all substances whether they are natural or chemical in nature.

Any participant found in violation of this policy will be immediately removed from the tour. In such cases, no refund will be given, and additional costs incurred due to early departure will be your responsibility.

7. Responsibility and Liability

Himalayan Rides is committed to providing high-quality, safe, and authentic travel experiences. However, we are not liable for delays, personal injury, loss, or damage caused by third parties, natural disasters, political events, or circumstances beyond our control.

Participation in adventure travel involves risks. By booking with us, you accept those risks and agree that Himalayan Rides, its staff, and partners are not responsible for any claims resulting from accidents, injuries, or unforeseen events during your trip.

8. License & Travel Documents

You are responsible for ensuring that your passport is valid for at least six months beyond the duration of your trip and that you have obtained all necessary visas and permits before arrival. We are happy to advise on entry requirements, but it is your responsibility to stay updated and compliant with relevant regulations.

Participants must hold a valid motorcycle license from their home country that covers the engine capacity of the motorcycle being used for the tour. An International Driving Permit (IDP) is also required for all riders. It is the participant's responsibility to ensure these documents are valid and on their person at all times during the tour. Failure to produce a valid license will result in the participant being unable to ride, with no refund provided.

9. Use of Images

During your trip, our guides or other participants may take photographs or videos. These may be used by Himalayan Rides for promotional purposes including our website, social media, and marketing materials. If you do not wish to appear in such media, please inform your guide at the beginning of your trip.

10. Rooming Policy

All tour prices are based on twin share accommodation with two people per room of the same gender. If you are traveling with a friend or partner, we are happy to accommodate roommate requests; otherwise, roommate assignments will be made at random with another participant of the same gender. Booking the "Single Room Option" ensures you will have a room to yourself; however, this is not in any way an upgrade in the standard or quality of the accommodation provided. Single rooms are subject to availability at each location. If any accommodation is unable to provide a single room, a pro rated refund for that specific night's supplement will be issued.

11. Upgrades and Supplements

Motorcycle upgrades are subject to availability at the time of the tour. If your chosen upgrade model is not available, a full refund of the specific upgrade fee will be issued. The inability of Himalayan Rides to fulfill any upgrade or supplement requests, including but not limited to single rooms or specific motorcycle models, does not constitute a justifiable cause for trip cancellation by the client, nor does it warrant a refund of the base tour price.

12. Motorcycle Damage & Liability

Participants are solely responsible for any damage caused to the motorcycle during the tour, excluding normal wear and tear. Himalayan Rides does not require a pre-paid security deposit; however, by booking this tour, the participant agrees to be held liable for the full cost of all necessary repairs, including genuine replacement parts and labor, resulting from accidents, falls, or negligence.

Assessment of damage will be conducted by Himalayan Rides mechanics at the end of the tour. The participant agrees to settle all damage-related costs in full before their International departure. Himalayan Rides is not responsible for mechanical failures caused by rider misuse, such as burnt clutches or engine damage from improper gear selection in technical terrain.

13. Complaints and Feedback

If you are unhappy with any aspect of your trip, we encourage you to speak to your guide or local contact as soon as possible. Most issues can be resolved quickly in the moment. If further action is required, please send your feedback in writing within 14 days of your trip's end, and we will do our best to address your concerns fairly and promptly.

14. Governing Jurisdiction

Any disputes arising from your booking or participation in a Himalayan Rides trip will be governed by the laws of Nepal. Any legal proceedings must be filed in a court of competent jurisdiction in Kathmandu, Nepal.
